Terms of Use

These terms are an agreement between you and Aitor Recalde, an individual in Georgia, USA ("we", "us"), who runs Oui Wish! on the web at ouiwish.app and as an iPhone app. By using Oui Wish!, you agree to these terms and to our Privacy Policy. If you don't agree, please don't use Oui Wish!.

Who can use Oui Wish!

You must be at least 13 years old. If you're under the age of majority where you live, a parent or guardian must agree to these terms for you.

Your account

You can sign in with Google or Apple, or continue as a guest. You're responsible for what happens in your account, so keep your sign-in secure. A guest's wishes are kept only until they sign out, and guest accounts unused for 30 days are deleted. To keep a guest's wishes, sign in with Google or Apple first. You can delete your account at any time from Profile.

Your wishes and lists

What you add to Oui Wish! stays yours. You give us permission to store it, show it to you, and show what you choose to share to the people you share it with, only so that Oui Wish! works. Please don't add anything that's illegal, that you don't have the right to share, or that's hateful or harmful.

Sharing

Anyone who has a link you share can see what you shared, without signing in. You decide what to share, and you can stop sharing at any time from Profile.

Shops, products and search

Oui Wish! helps you keep track of things you want; it doesn't sell them. Names, prices and pictures come from shops' websites and search results, and may be out of date or wrong. Anything you buy is between you and the shop. Links to other websites are for convenience: we don't control those sites and aren't responsible for them. "Search online" may not be available to everyone, and we may change or limit it.

Using Oui Wish! fairly

Please don't misuse Oui Wish!. For example, don't try to get into other people's accounts or data, don't interfere with or overload the service, don't get around its security checks, don't copy it or use bots or scrapers on it, and don't use it to break the law.

Changes, and ending things

Oui Wish! is free, and we may change, add or remove features. We may suspend or close an account that breaks these terms. You can stop using Oui Wish! and delete your account whenever you like.

Disclaimers

Oui Wish! is provided "as is" and "as available". As far as the law allows, we make no promises that it will always be available, error-free or secure, or that information from shops and search results is accurate, and we disclaim all implied warranties, including of merchantability, fitness for a particular purpose and non-infringement.

Limits on our liability

As far as the law allows, we aren't liable for any indirect, incidental, special, consequential or punitive damages, or for lost data, profits or goodwill. Our total liability for any claim about Oui Wish! is limited to US$50. Some places don't allow these limits, so they may not all apply to you.

The iPhone app and Apple

If you use the iPhone app, these terms are between you and us, not Apple. Apple isn't responsible for the app or its content, and has no obligation to provide support or maintenance for it. If the app fails to meet any warranty that applies, you may notify Apple, and Apple will refund the purchase price (Oui Wish! is free); otherwise Apple has no warranty obligation for it. Apple isn't responsible for any claims about the app, including product liability, legal or regulatory requirements, consumer protection, or intellectual property claims. You confirm that you're not located in a country subject to a US Government embargo, and that you're not on any US Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You must also follow Apple's terms for using the App Store.

Law and disputes

These terms are governed by the laws of the State of Georgia, USA, without regard to its conflict-of-law rules. Any dispute will be handled by the state or federal courts located in Georgia, and you and we agree to their jurisdiction.

Changes to these terms

If we change these terms, we'll update the date at the top, and we'll let you know in Oui Wish! about any important changes. Using Oui Wish! after a change means you accept the new terms.
